That'd be copyright infringement, not counterfeiting. More importantly, what Nvidia is doing isn't either. They aren't selling a copy of the game data to people without permission (that'd be a question of first sale doctrine), they're letting you run a game, which you already legally paid for, on their server and then streaming the audio & video to your local client. Same thing as using Steam Link, except you're using Nvidia's hardware instead of your own.
Most importantly, I'm not just making stuff up here: users hosting and playing back content on another company's server was already decided to not be copyright infringement 15 years ago in Cartoon Network v. CSC Holdings. Nvidia is simply not pushing back because they're trying to play nice and not anger game companies by taking this to court.
