Nintendo doesn't ever sue over some things and always sue over other things. They are ok with fan art, remixes and covers, rom hacks. They aren't ok with reuploads of their songs with no changes or fan games that use their IPs and are also based in an original engine. Just understand what the rules are and you won't get sued
