Maybe it differs state by state, but my lawyer told me my student loans were 100% mine, even though my soon to be ex wife had also lived on them when I was finishing grad school and she was unemployed.

Also, marriage is definitely a good financial investment. Splitting expenses, tax breaks, etc. It's the almost inevitable divorce that's ruinous financially. My divorce set me back 10-20 years in terms of being able to retire. The only reason I'll be able to retire at all is because I will have a state pension that my lawyer was able to keep my ex's claws off of.

My understanding is that it depends on when you first acquired the debt. If you agreed to take on the debt prior to marriage then it is your own responsibility. If you agreed to take on the debt while married, then the debt can be split between parties. The only way this changes is if there was some language in a prenup agreement which specified dealing with assets and liabilities in some other way.

I acquired the debt after we got married. My lawyer said there was zero chance the judge was going to assign any of my student loans to her. Maybe it's a difference between common law and community property states?

There are some financial arrangements that family courts have no say over. For example, I kept the house and the mortgage. The court said I have to pay the mortgage, but if I don't, well, my ex is still listed on the mortgage, and my nonpayment is still going to ruin her credit and the bank can go after her. On the basis of the divorce decree saying I have to pay the mortgage, she could go back to court and have me held in contempt for not complying, but that wouldn't unfuck her credit or prevent the bank from taking her to court. Another thing the court couldn't do was order me to refinance the mortgage in my name only, to relieve her of her obligation; a family court can't order a bank to loan someone money.

If you like each other just live together, there is no reason to get the government involved.
