If caught with it, they'll charge and arrest you even still. Simikar to that, kratom is another drug that is sold over the counter at smoke shops. I heard it gives you a high, but depending on what kind it is, that'll determine what kind of high you'll get. The red kratom you should stay away from because it's marketed for opium withdrawals and harm reduction and it'll cause the same opioid withdrawal symptoms as the real thing. But others can be more like stimulants.
Picrel is what these hemp products look like. Marijuana is still illegal, but these are just hemp flowers sprayed with THC chemicals (like THCO, Delta-8/9/10, HHC, and so on). Its been legal since the Farm Bill was passed in 2018.

Kratom comes from the same family of trees as coffee. It is useful because of it's atypical opioid receptor activity but it does not recruit the protein beta-arrestin which is responsible for respiratory depression of all other known analgesic opioids. The difference between red/green/white vein kratom is not necessarily indicative of it's activity. It is similar again to coffee. While we are not sure exactly why different coffee from different regions causes distinct different effects, it is also not different enough that I would consider coffee from south america substantially different from coffee from ethiopia, even though it is subjectively.

The reason it’s illegal has nothing to do with morals or culture. Cannabis seems to be an engineered plant that has a great deal of utility to humans.
