Also one thing to add about this, the Presidential records act apparently applies to any unpermitted documents, classified or not, that are held by the POTUS after leaving office. So that will be important to this story too.

The attorney said no.

That's not how it works. There is a long process that has to happen even for presidents. They have to go through all kinds of other documents they affect and determine what needs to be declassified in those as well.

The Espionage Act also doesn't take classification into account. So whether the documents were declassified really doesn't matter in the eyes of the law. Also, what shows up in the FBI report is probably just what the documents were marked with originally, regardless of the information had later been declassified, not that it actually matters.
