As soon as the person put any part of their body through a window, THAT was the time to do something. Of course, anything fun is going to wind up with the driver (or at least the upholstery) covered in the dude's blood or mace. Once that moment has passed it's gone and the situation has changed. Officer offered for the driver to file a complaint. The officer's response isn't controversial here: They're offering to help in the capacity that the law allows them to at that moment.

Even in a brief incident like this, observable facts start being produced rapidly- like an old tickertape machine spitting out paper. Look at the tape up to a certain point that the facts point to one reasonable conclusion. Add more length into consideration and the facts might point to another reasonable conclusion. Look at the ENTIRETY of the tape and a third, completely different, reasonable conclusion could appear. The cop is looking at all of the ticker tape. The driver is looking at a subset of that.

Why do I bother to make a distinction? Because it doesn't matter what you or I or the driver OR the cop thinks. It only matters what the DA thinks and the DA is going to look at the entirety of the tape, all the evidence, to draw a conclusion they believe a jury will agree with.

Let's say she maced the dude or blew his face off the SECOND his head came through the window: She's frozen the tape at exactly the right spot to make her look most favorably. But she didn't and a cascade of facts after that moment appear to support the idea that it was a mentally unwell person acting mentally unwell.

BTW, long-time criminals know everything I just wrote above and they memorize it. Which is why when a dude like this comes up to you and you flash a pistol or mace or whatever, they immediately turn around and start walking the other way. Since you didn't shoot them in that moment, they have now satisfied the law's requirement of "disengaging" from the situation. It's no longer the situation it was just a few seconds before.

Long story short a schizo tries to open up a girls car doors in traffic telling her to get the fuck out leans and tries to open up her door through her window. A cop nearby tells her to leave the schizo alone because he’s unwell and she can file a complaint if she wants (while the schizo runs off to try and carjack someone else)
