He can declassify anything, at any time, for any reason. He will just argue that he did. The dem court will find him guilty and then the supreme court will overturn it.

"His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant."
Therefore the president alone decides what is classified and how to divulge that information and congress and the courts have no authority over it.
