They have the authority to delay the certification for a short period of time to allow some lawsuits to move forward. It would have been a very reasonable concession to prevent the kind of political tension we're currently dealing with. The "peaceful" part stopped when FBI assets incited people to trespass in the capitol building and capitol police waved them in. Trump wasn't looking to delay certification, he wanted Pence to block certification out outright to send it back to the states where the Republican state legislators would then override the will of the people and steal the election for Trump. Blocking certification is not only illegal, but unconstitutional.

Rather, if trump or an aide has any documents, emails, files, accidentally or unknowingly - if the FBI can find anything on a site that is not the Whitehouse on any devices that has briefing, known or unknown about, if there is mention of nukes, in any context, public or privileged information, legally which is the most important thing here, is a case can be brought against trump(as the property owner) and of course the headline of any article will infer exactly what the Dems want it to infer.
