Any good defense lawyer will advise you to plea the 5th, especially if facing a malicious prosecution. Nothing you could possibly say will help your case, they will only use it to build whatever case they are trying to build against you. If they want the truth, they can have it in a court of law.

Constitutional amendments are designed to protect primarily the innocent and the guilty might use it to avoid testifying against themselves. Are you suggesting that people should have to be forced to testify against themselves? There's a reason why police say "anything you say will and can be used against you." whenever they read you your rights.
Also if a person pleads the fifth nothing can be implied from it by a judge or lawyer. Period. If not it could lead to impeachment for a judged or disbarment for a lawyer.
