The Founders intended the US to be a white ethnostate but defined white as English or English-Scottish only

White was never defined by The US Congress. As such, courts have always had to be the ones deciding.

While that was one of Senator Calhoun arguments, that is in fact false. All Mexicans on the stolen land were allowed to leave or stay. If they chose to stay they were automatically made US citizens without the need for naturalization. This was included in the under-duress treaty of Guadalupe-Hidalgo. The treaty couldn't violate US-law, so this legally had to bind Mexican nationality with being White in order for those that stayed to assent into US citizenship, since being a US citizen at the time required you to be a "free-white person".

Funnily enough, this was challenged in Buffalo, NY not long after the treaty was forcibly signed when two Indigenous Oaxacan-Mexicans attempted to naturalize themselves in New York. These weren't Mexicans that were on the other side of the stolen land when the open hostilities had ended. These were recent arrivals after the land theft was completed. Their naturalization was challenged by the local government on the grounds that they couldn't be naturalized and attain US citizenship because they were clearly not white. This lead the US Department of State and the US Attorney General to get involved, because otherwise it could have created a crisis of of confidence in the treaty and could have been Mexican grounds for treaty annulment and or renegotiation on grounds of bad-faith recognition and application.

This led to these clearly non-white, and very indigenous Mexicans to get US citizenship. This was a time when US immigration laws besides being a free-white person were practically non-existent. This understanding implied by executive action, legislative intention (consent of the US Senate), and judicial understanding of Mexicans by nationality being considered WHITE.
