His attorneys gave it to them and the lawyer advised them of the mistake, they had several days to respond. The lawyers didn't respond and it became free and clear of all claims of privilege. But information shared with a third party other than your lawyer is not privileged. When he downloaded the images he shared that information with a third party that was not a lawyer.
