Their argument is that you must get receive clear positive consent or it is rape. Imagine a scenario where the woman "freezes up" as you start kissing her or whatever. She doesn't resist, and you don't get violent or coerce her, but she never says "yes Hans, let's have sex". According to Swedish law, she could accuse you of rape. It all hinges on consent, which means you must prove that you were given consent.
