It doesn't really matter, not having your rights read isn't a "get out of jail free" card. Having your rights read only matters if they need to rely on something you say in questioning to get the conviction; not having your rights read simply means they can't use anything you say in court. But if they catch you with something red handed (as in this case), they don't NEED anything from you in questioning, they have solid hard proof you committed a crime, nothing you can say will change that. And even if they DO need to rely on something you say during questioning IT STILL DOESN'T MEAN YOU GET TO GO FREE, it just means they can't use it in court. Only if you get convicted of something and then appeal based on not having your rights being read to you and the state used something you said as a critical piece of evidence is there any chance of getting out of it, and even then you need to convince an appeals court that without you having said that you would have been found innocent, good luck with that.
