This same judge, a Jimmy Carter appointee, also threw out the Washington Post case. But he allowed it to continue on appeal, resulting in a settlement to Sandmann’s favor.
From today’s Lexington (KY) Herald-Leader:

The judge that dismissed this suit is William Bertelsman. He's the same judge that in 2019 dismissed the sandman's case against the Washington Post.
NBC settled with the Sandman for an undisclosed amount, and an NDA requiring that he not disclose how much the settlement was.
They're currently appealing the dismissal for the Washington Post so they will probably appeal this dismissal too.
