What I assert is that raping the unconscious only becomes a crime if it is recorded or if it leaves STDs / impregnation behind, since there is actual litigy as the act was recorded / left evidence and serves as an embarrassment for the victim.
A crime requires victimization. If the victim cannot identify themselves as a victim, there should be no crime.
