It's surprising that none of the major news sites have picked up on the HUGE story out of Colorado today which is that an Obama appointed judge in the District of Colorado, Raymond Moore, issued a temporary restraining order enjoining the Town of Superior, Colorado from enforcing its ban on "assault weapons" and magazines that can hold more than ten rounds of ammunition. Citing NYSRPA v. Bruen the judge applied the text, history, and tradition test and found that there is no textual basis and no historic analogue permitting the government to ban these classes of protected arms. Determining that plaintiffs have a very high likelihood of success on merits at trial he issued the TRO. The case is Rocky Mountain Gun Owners et al v. Town of Superior and it is case number 1:22-cv-01685. This is the first action taken against an "assault weapon ban" and a magazine capacity limit post NYSRPA v. Bruen and it is beautiful to see. While not precedential, the order granting relief to plaintiffs can be cited in other actions and may be persuasive in order venues.
I wonder if the news folks just haven't heard the decision yet or if they are intentionally ignoring it because it doesn't fit their narrative.
