I agree it's more than enough to get to the good stuff in court, where Musk will almost certainly be able to construe it as over 5%, and that will probably be enough to let him back out of the deal or renegotiate it.

A Carnegie Mellon study found 82% of the 50 most active COVID misinformation accounts were bots. If the total is below 5%, there's certainly some definition of "active" that isn't.
