The Supreme Court has never been above Presidents and Congress, they just placed themselves there in 1803 or 1804 and everyone let them do it with that Judicial review nonsense (really Congress and the President do that, or are supposed to).

Technically the Supreme Court only exists because people believe it does. They have zero enforcement, no court police, nothing to make states enforce their rulings. Everyone could just ignore them if they so chose to do so. They wont of course.
