The EO gives the NG and DPS the authority to arrest illegals and return them to the border at the nearest port of entry.
How this will play out in reality isn’t known. What has happened in the past is that the Guard and DPS have had to turn illegals over to ICE or Border Patrol.
It isn’t clear yet whether they will do the same at the border or not.
But what it does mean is that DPS can arrest illegals anywhere in the state and send them to the border, rather than playing the catch and release game. And the Guard doesn’t have to let them cross the border.
