Because all agencies exceed their statutory authority. Lets take the IRS for example, the 'wash sale' rule is not a law, it's something the beuarucrats pulled out of their asses and enforce as if it was law passed by congress.

Aren't the other agencies, say ATF for example, given explicit orders by congress to make rules in relations to Alcohol, Tobacco and Firearms?

That’s the problem. The orders being given, or in the case of Covid, never actually being given explicitly is the problem. You can’t just earmark funds for an agency and say go nuts solve x problem. You need to be explicit in planning and budgeting those funds and auditing the work as it proceeds to ensure taxpayer funds are spent appropriately and without waste

Yes, agencies like the atf just make up rules they consider laws and change their minds at the drop of a hat. Currently the atf is trying to say pistol braces are illegal after saying a decade ago that pistol braces were fine but you couldn’t shoulder them, then they said no wait, you can shoulder them, now wait having one of the 50m braces we said were legal to sell and use is now illegal and if you have one you are breaking the law.
