It won't really matter in this case because many states are now legalizing weed, and the Supreme Court had additionally ruled back in the 90s (in a case that Thomas was a part of) that states aren't obligated to enforce Federal laws. Once enough states legalize weed, the Federal laws on it become unenforceable and moot.

I also wonder if lefties will ever realize that almost all Federal drug laws were passed by Democrat presidents and/or Congresses.
