Yes, the best way to get something on the cheap in the form of kickbacks. (This is basically how this works. Big three formula producers all give rebates/cashback deals to get these WIC contracts)

If they sued for breach of contract, then threw the contract out and went to another provider (let's say Nestle wins the monopoly contract this time) then you're in the same problem but worse because now there's only 2 major companies instead of 3 fighting for those state monopolies.
Can't admit that you've made the mess either. That would be bad for your career. So we just play the blame game and throw money around to make headlines.
