No, it is not a crime, surrendering troops and "surrendering a city" do not mean the same thing. Assuming this is true (and I highly doubt it), what the Ukrainians would be doing is a kind of "false retreat" to then launch a counterattack and surround the city. That is a strategy, not a war crime. But there is no point in discussing this anyway because so far the Ukrainian army has not launched any large-scale counter-offensive (no, taking back a village with a dozen soldiers is not a large-scale offensive), so I highly doubt this is true

no, "surrender a city" is not the same as "surrender soldiers." In fact, if this was true, then the Ukrainians would be doing exactly what the Soviets did in Stalingrad, ie letting the enemy take the city and then surrounding it in a counterattack.
