Depositions are generally considered as background that informs other foundational evidence and allows for subpoenas for evidence and witnesses. Civil cases are very different from criminal cases and don’t have the same expectations or requirements for evidence, that is a very long topic I’m not able to discuss. Consider that depositions used to be written testimonies similar to police reports and other written statements given under oath and how they are used in cases. You have both legal teams interviewing the person and statements are later redacted in presence of the judge. All this is to provide some kind of foundational evidence from someone who witnessed events in question so the case can proceed and further evidence can be admitted and witnesses can be called. Usually it’s the doorman who saw a guy walk in and leave an hour later, there’s no point grilling him on the stand when you subpoenaed the elevator tapes.
First of all, most cases never go to trial and rely on depositions for settlement. Most often, after giving a police report or deposition in the US legal system, neither side wishes to pursue the individual as a trial witness because it benefits neither of them. It calls a lot of bullshit into question at worst and wastes time at best. Not calling a witness pretty much means they saw something but didn’t see shit and whether they’re lying or not doesn’t matter much because other facts line up. If this were a good detective novel as opposed to a shitty one, the barman who saw the broad talking with a greaser is about what a deposition is generally worth. It’s evidence but it’s more where evidence follows from than the real shit like a shutin with a long lens over the alley or i dunno, someone who saw depp smack her ass and took some pictures of her busted up face.
