the ATF can't make material changes to the law by warping definitions. They are not a law-writing entity.

It means that Congress created agencies(like the FDA for example) cannot create "rules"(laws) that the public has to follow. Since technically only Congress can create laws according to the constitution and that these agencies are violating the constitution with their "rules"

In my jurisdiction, our legislature routinely passes laws establishing regulatory bodies and specifically giving those bodies the right to publish detailed regulations (secondary law). If you breach those regulations, they can bring a prosecution against you, but the trial is in a regular court.

Probably immediately appealed, and kept in limbo for as long as possible. Regulators won't have to worry. Business as usual. If supreme court ultimately rules lol, unconstitutional, no damages because gov. Meanwhile, company and individuals will pay up to regulators because like fuck you want to get fucked by gov.
