Gentlemen, I hereby propose the following Agreement, effective immediately upon ratification. It is called the European Recognition of People's Agreement or Eu.R.O.P.A. (Stylized "EUROPA") in short. This Agreement would dissolve the European Union, NATO, the Schengen Agreement, European Economic Area and European Free Trade Association and replace it with a new organization following the principles outlined as follows. The European Recognition of Peoples Agreement Article 1. Europe and her People Section 1. Geographical Europe is defined as follows: 1. The lands west of the Ural mountain range and the Ural-Caspian Narrowing. 2. The lands north of the Caucasus mountain range. 3. The lands and islands east of Greenland. 4. The lands east of the Atlantic Ocean. 5. The lands north of the mediterranean sea. 6. The lands north of the strait of Gibraltar. 7. The lands west of the strait of Bosporus. 8. All islands in the Adriatic, Balearic, Ionian and Tyrrhenian Seas. 9. The Following Mediterranean Sea Island Groups: Pelagie, Maltese, Cyprus, North Aegean, Sporades, Cyclades, Dodecanese, Saronic and Cretan.
Section 2. European nativity is defined as follows: 1. The ethnic group was present over 1000 years ago (1000 AD or earlier) in Europe. 2. The ethnic group developed within the last 1000 years in Europe from a native ethnic group.
Article 2. Sovereignty Section 1. All Member States agree to guarantee the Sovereignty of all other Member States, by military force if necessary.
Section 2. Infringement of a State's Sovereignty shall be defined as follows: 1. Military Action taken against a Member State by a foreign State. 2. Economic Sanctions imposed on a Member State by a foreign State. 3. Attempts to influence the political process of a Member State by a foreign State. 4. Illegal Entrance of a Member State's territory by a foreign national.
Section 3. This article will also apply to any Non Governmental Organization present in or supported by any Member State.
Article 3. Membership Section 1. Membership shall be allowed to those Sovereign Nations that fulfill the following requirements: 1. The Nation's inhabitants must be majority native European. 2. The Nation's capital must be within the borders of geographical Europe. 3. The Nation must not currently be at war or occupying territory of a member state. 4. The membership must be accepted by at least 3/4 of member states in a public vote.
Section 2. Member states can be expelled for the following reasons: 1. Infringement of another Member State's Sovereignty. 2. Failing to come to the Defense of another Member State. Expulsion requires a public vote held by all member states, with at least 3/4 of all member states agreeing to the expulsion.
Section 3. A permanent council shall be made for this organization to which each Member State shall appoint one Ambassador.
Article 4. International Agreements Section 1. Member States shall not impose tariffs on other Member States which exceed the tariffs those Member States have imposed on non-Member States.
Section 2. With the exception of Section 1, Member States will be able to freely make military, political and economic agreements between another.
Section 3. Violation of Agreements made between Member States shall be resolved as follows: 1. The aggrieved Member State shall publicly plead their case to this Organization. 2. The accused Member State shall publicly respond with an explanation. 3. The aggrieved Member State will be able to respond, followed one last time by the accused. 4. A vote will be held by all Member States in favor of the aggrieved, which will require 3/4 in favor to pass. 5. If the aggrieved finds the accused to infringe on their Sovereignty, any proposed expulsion will require a separate vote.
Section 4. In the case of war, peace treaties will be negotiated by a council of all Member States, chaired by the Member State whose Sovereignty was infringed.
Section 5. With the exception of Section 4, this organization shall have no power to make or enforce agreements with outside parties on behalf of its Member States.
Article 5. Restrictions Section 1. This agreement shall have no power to enforce any constitution.
Section 2. This agreement shall have no power to enforce any laws.
Section 3. Member States shall have no obligation to assist Member States militarily in offensive military actions.
Section 4. Member States shall have no obligation to impose economic sanctions on non Member States by other Member States.
Section 5. Member States shall not interfere in the internal conflicts of any Member State.

What about sepretest movements or places like Catalonia?
Is Spain infringing on their sovereignty? What if say, Sardinia which has its own language wants to succeed.
How are the nation's defined? Or what if one part of a nation wants to join another nation... Like the Ukaraine situation. Say if Bavaria wanted to leave Germany and make union with Austrian Tirol? Is Austria's sovereignty being infringed in such a situation? Is Germany's? Or... Is bavarias and tirols sovereignty being infringed if they are now allowed to do so?
Seems like a complex issue. The lines are not as cut and dry as you would like to think

Member States aren't automatically added, user. They have to apply as sovereign states first and be accepted by the current States.

These would be internal issues and as such not within the scope of the Agreement. Only when those breakaway states would be accepted as Member States, would their sovereignty be within the scope.
