They carry a yellow arm band. There's pretty much an understanding on both sides that if you're wearing non-civilian clothing, such as camo, and wear an arm band, you meet the "distinctive insignia" requirement. If you carry arms openly and have some chain of command, you're a lawful combatant.
The difference here is that an unlawful combatant is NOT a POW when detained, but can in fact be tried and executed. A lawful combatant cannot typically be tried for merely conducting hostilities.

I don't know the specifics about the geneva convention but it doesn't matter. That was never the point a civilian with a yellow arm band is just a civilian with a yellow arm band.

The Geneva Conventions give you as a civilian certain protections you do not otherwise have. When you become a lawful combatant, you lose many of these. When you become an unlawful combatant, you lose pretty much ALL of them. A captured unlawful combatant, for instance, is not a prisoner of war.
Also, nobody is going to give a fuck about national law on defending your home. For starters, if you are not being attacked, you don't get to raise self-defense. You might also be unable to raise self-defense in protection of property.
