If theft is legal that defeats the whole point. An ancap society can't function without a common agreement of ethical principles among the ancap society, so some sort of law, formal or informal. Look at Iceland and other frontier societies to see how this works in practice. Law was neccesary to maintain property rights, even though there were no taxes.
