Here’s a QRD on parameters of Durham’s authority.

Durham's authority is set forth by statute and does not require DOJ input.

October 10, 2019 Order No. 4878-2020 [1] from Barr appointed Durham as Special Counsel ("SC") under 28 U.S.C. §§ 509, 510, 515, explicitly authorization Durham to prosecute federal crimes arising from his investigation of these matters. Barr also notes that 28 C.F.R. §§ 6004. to 600.10 are applicable to SC.

28 U.S.C. §§ 509-510 allow Barr to delegate his authority as Attorney General. 28 U.S.C. § 515 states that S.C., as specially appointed by Barr, may "conduct any kind of legal proceeding, civil or criminal, including grand jury proceedings and proceedings before committing magistrate judges, which United States attorneys are authorized by law to conduct, whether or not he is a resident of the district in which the proceeding is brought."

28 C.F.R. §§ 600.4-600.10 outline the scope of SC authority in detail:

28 C.F.R. § 600.4 - AG establishes SC jurisdiction. Done by Barr and appears expansive (Durham has prosecuted in multiple jurisdictions).

28 C.F.R. § 600.5 - Durham gets to ask for staff (spent $10MM+, dozens of attorneys, hundreds of thousands of pages and over 100 witnesses interviewed, grand jury empaneled, etc.)

28 C.F.R. § 600.6 - SC has discretion as to how much he needs to report to AG (key autonomy given DOJ run by Garland now, one of the most important aspects shills ignore).

28 C.F.R. § 600.7 - (b) Holds SC is not subject to day-to-day supervision of any official of DOJ. Again, shills ignore autonomy. AG is authorized to refute SC only if "action is so inappropriate or unwarranted under established DOJ practices that it should not be pursued." Incredibly high standard to overcome. Coupled with "AG will give great weight to the views of the SC." That's why Garland hasn't done anything. AG can remove SC if "Attorney General may remove a Special Counsel for misconduct, dereliction of duty, incapacity, conflict of interest, or for other good cause, including violation of Departmental policies." Again, very high standard. AG would need to explain termination in writing as well.

28 C.F.R. § 600.8 - SC must be provided appropriate resources based on yearly request to AG. SC is only required to report “significant events.”

28 C.F.R. § 600.9 - AG must report to Congress if he removes SC or prevents SC from doing something under 600.7(b). Again, more oversight to pressure Garland not to get involved, as he’d be the center of attention. AG may order public release of SC report. Barr has already done this. 28 C.F.R. § 600.10 isn’t substantive.
