The 23* tilt is constant. It's always tilted the same amount in the same direction. Polaris is close to the alignment of the tilted pole so it looks like it's in the same spot.

maybe this is your problem. It's not that the Earth is wobbling 23 degrees over the course of a day. It's "tilt" is 23 degrees with respect to its orbital plane around the sun. So this angle is always the same as it rotates each day, so the north pole is always pointing roughly at polaris

Because the earth doesn’t spin parallel with its rotation around the sun. That is what Neptune does. It is the only planet to do so. So it’s purely by convention and neither approach is wrong.
