you could easily throw in another scene that shows all of the suspicious characters just going about their business or you could have the next scene as a funeral. So clearly he doesn't want to go there, instead he shows what life is like now, however long it may last.

there's no reason to kill him off. it's much more interesting from an artistic point of view to just step away, and from a commercial point of view you leave it open for a possible life-on-the-run or comeback story. at least until your lead actor eats himself to death.

He's never explicitly said, to my knowledge, that Tony dies in the last scene. It's always constructed from a couple of quotes from a discussion session about the behind the scenes book.
Again if he wanted him dead, it would be easy to show. Don't you think they had discussions about this while filming? That the ending would be ambiguous? So, even if in his mind Tony dies, he deliberately decides not to show it.
