I wonder if Ethereum passes the Howey test. I think it does, even after PoS. The only issue was (4) expecting profits from the work of others.

Usually (4) affects chains like Polkadot, Cardano, Solana, etc basically every NPoS (nominated/delegated proof of stake). You may expect profits by doing literally nothing. Let's face it, staking takes no effort, yet users earn staking rewards from the work of validators.

On the other hand Ethereum doesn't natively support delegators, you either run a validator node (which is a lot of work) or you don't. If you don't feel like running a node and/or have a lower amount of eth, you can pool via staking pools but these are not native solutions to Ethereum, correct?
