The indonesian guy, the captain give out correct order movement and the ship could have avoid colliding with the rock, but the indo guy fucked up the order and the ship hit the rock
too bad they never catch him, but he would only need to serve 1-2 years at max since both the company and the government used the captain as the scape goat for the whole fiasco.

I would say that the fault fall on the victims more than the goverment. The captain of the ship announced that everything is fine and asked the victims to stay in their fucking room lol,m and no one protest and they just happily go back to their rooms while in the costa case, the passengers rushed to the side of the ship and pretty much ignored the captain order to stay calm. And most of the passengers on the costa survived because they are not meer sheep that can be easily manipulated
